TRANSPARENCY - TERMS OF SERVICE

1. ACCEPTANCE OF TERMS
By downloading, installing, or using the Transparency mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
TransparencyApp LLC ("we," "us," or "our") provides the App subject to these Terms, our Privacy Policy (available at https://transparencyapp.io/privacy), and our Community Guidelines, all of which are incorporated by reference.
2. DESCRIPTION OF SERVICE
Transparency provides users with access to information about government officials, including:
- Congressional stock trades with performance data
- Voting records and bill information
- Committee assignments and contact information
- AI-generated bill summaries and analysis
- Social platform for discussing government transparency
3. LICENSE GRANT
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple device that you own or control, solely for your personal, non-commercial use.
You may not:
- Copy, modify, or create derivative works of the App
- Reverse engineer, decompile, or disassemble the App
- Rent, lease, loan, sell, sublicense, or distribute the App
- Use the App for any illegal or unauthorized purpose
- Use automated systems (bots, scrapers) to access the App
- Attempt to gain unauthorized access to our systems or other users' accounts
4. USER ACCOUNTS
To access certain features of the App, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain the security of your password and account credentials
- Notify us immediately at support@transparencyapp.io of any unauthorized use
- Be responsible for all activities that occur under your account
- Not share your account credentials with others
We reserve the right to suspend or terminate accounts that violate these Terms.
5. AUTO-RENEWABLE SUBSCRIPTION TERMS
5.1 Premium Subscription
The App offers an optional auto-renewable subscription ("Premium Subscription") that provides access to premium features, including unlimited AI-powered questions about any legislation.
SUBSCRIPTION OPTIONS:
- Monthly: $5.99 per month
- Annual: $59.99 per year (equivalent to $4.99 per month)
5.2 What You Get With Premium
Premium subscribers receive:
- Unlimited AI questions about any bill or legislation
- Advanced bill analysis and personalized explanations
- Ad-free experience (if applicable)
- Priority customer support
5.3 Automatic Renewal
Your subscription automatically renews at the end of each subscription period (monthly or annually) unless you cancel at least 24 hours before the end of the current period.
You will be charged for renewal within 24 hours prior to the end of the current subscription period at the rate of your selected plan.
5.4 Payment
Payment will be charged to your Apple ID account at confirmation of purchase. If we cannot charge your payment method for any reason (such as expiration or insufficient funds), and you have not cancelled the subscription, you remain responsible for any uncollected amounts.
5.5 Managing and Canceling Your Subscription
You may view, manage, and cancel your subscription at any time by:
- Opening the App Store on your device
- Tapping your profile icon
- Tapping "Subscriptions"
- Selecting Transparency
- Tapping "Cancel Subscription"
Alternatively, go to Settings > [Your Name] > Subscriptions on your iOS device.
Cancellation takes effect at the end of the current billing period. You will retain access to premium features until the end of your paid period. No refunds will be provided for the unused portion of any subscription period, except as required by applicable law.
6. DATA COLLECTION, USE, AND AGGREGATE POLLING
6.1 Personal Information We Collect
When you create an account, we collect:
- Authentication information (Apple Sign-In or Google Sign-In)
- Age and state/district (for representative matching)
- Optional demographic information (gender, education level, income range, party affiliation)
6.2 Political Alignment Quiz and Bill Voting
You may optionally:
- Take a 20-question political alignment quiz covering economic, healthcare, environmental, social, and foreign policy topics
- Vote on current bills and legislation (support, oppose, or neutral)
This data is used to:
- Provide you with a personalized report showing which politicians align with your views
- Calculate and display your percentage match with elected officials
- Show you community statistics (e.g., "67% of Transparency users support this bill")
6.3 IMPORTANT: Aggregate Data for Business Purposes
WE AGGREGATE AND ANONYMIZE USER DATA TO CREATE POLLING REPORTS THAT WE SELL TO THIRD-PARTY ORGANIZATIONS.
By participating in the political alignment quiz or voting on bills, you explicitly consent to us aggregating and anonymizing your responses to create polling data that may be sold to:
- Polling companies (e.g., Gallup, Pew Research, YouGov)
- Political campaigns
- Think tanks and policy research organizations
- News organizations
THIS AGGREGATE DATA:
- Is completely anonymized (no individual user can be identified)
- Does not include your name, email address, phone number, or device identifiers
- Is presented only in statistical/aggregate form (e.g., "68% of users aged 18-24 in California support climate legislation")
- May be segmented by demographics (age, gender, state, education, etc.)
- Helps fund the free features available in the App
YOU MAY OPT OUT by simply not participating in the political alignment quiz or bill voting features. This will not affect your ability to use other features of the App (viewing voting records, stock trades, and bill summaries).

7. USER CONTENT AND SOCIAL FEATURES
7.1 Your Content
You retain ownership of any content you post on the App ("User Content"), including posts, comments, correlations between politician actions, and other contributions to the social feed.
By posting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to use, display, reproduce, modify, and distribute your User Content in connection with operating and providing the App.
7.2 Your Responsibilities
You represent and warrant that:
- You own or have the necessary rights to post your User Content
- Your User Content does not violate any third-party rights (including intellectual property, privacy, or publicity rights)
- Your User Content complies with these Terms and all applicable laws
7.3 Content Moderation
We reserve the right, but have no obligation, to:
- Monitor, review, or remove User Content
- Suspend or terminate accounts that violate these Terms
- Report illegal activity to law enforcement authorities
8. ACCEPTABLE USE POLICY
You agree not to:
- Post false, misleading, defamatory, or fraudulent content
- Harass, threaten, intimidate, or harm other users
- Impersonate any person, entity, or government official
- Post spam, advertisements, or unsolicited promotional content
- Share content that violates intellectual property rights
- Post illegal, obscene, hateful, or violent content
- Share others' private information without consent
- Use the App to coordinate illegal activities
- Attempt to manipulate community statistics or polling data
- Interfere with or disrupt the App's functionality or security
- Use automated systems, bots, or scrapers without permission
- Violate any applicable local, state, federal, or international laws
9. GOVERNMENT DATA AND AI-GENERATED CONTENT
9.1 Data Sources
The App aggregates publicly available data from official government sources, including:
- Congress.gov (official legislative information)
- Congressional stock disclosure databases
- Committee assignment records
- Voting records and roll call data
We strive to provide accurate and up-to-date information. However, we rely on third-party data sources and cannot guarantee complete accuracy, timeliness, or completeness of all information.
9.2 AI-Generated Summaries
Bill summaries and responses to Premium user questions are generated using artificial intelligence (Google Gemini). While we work to ensure accuracy:
- AI-generated content may contain errors, omissions, or misinterpretations
- Summaries are simplified for general understanding, not legal precision
- You should consult the original legislation text for complete accuracy
- AI responses reflect the state of training data and may not capture the most recent updates
9.3 Not Professional Advice
NOTHING IN THE APP CONSTITUTES:
- Legal advice or legal representation
- Financial advice or investment recommendations
- Tax advice or tax planning services
- Official government communications or endorsements
The App provides information for educational and civic engagement purposes only. Always consult qualified professionals (attorneys, financial advisors, tax professionals) for decisions requiring professional expertise.
9.4 No Investment Recommendations
Information about congressional stock trades is provided for transparency purposes only. We do not recommend buying, selling, or holding any securities. All investment decisions are your sole responsibility.
10. INTELLECTUAL PROPERTY
10.1 Our Rights
The App and its original content (excluding User Content), including software, text, graphics, logos, icons, images, audio clips, data compilations, and the compilation thereof, are the exclusive property of TransparencyApp LLC and are protected by U.S. and international copyright, trademark, patent, and other intellectual property laws.
10.2 Trademarks
"Transparency," the Transparency logo, and other marks are trademarks of TransparencyApp LLC. You may not use these trademarks without our prior written permission.
10.3 Restrictions
You may not copy, modify, distribute, sell, or lease any part of our App or its content without express written permission. You may not reverse engineer or attempt to extract source code from the App.
11. THIRD-PARTY SERVICES
The App may contain links to third-party websites or services that are not owned or controlled by TransparencyApp LLC. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.
You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by your use of any third-party content, goods, or services.
12. DISCLAIMER OF WARRANTIES
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- WARRANTIES OF MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- TITLE
- QUIET ENJOYMENT
- ACCURACY OF DATA
- SYSTEM INTEGRATION
WE DO NOT WARRANT THAT:
- The App will function uninterrupted, securely, or without errors
- Defects will be corrected
- The App or servers are free of viruses or harmful components
- Results obtained from the App will be accurate or reliable
- The quality of any information obtained through the App will meet your expectations
13. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
IN NO EVENT SHALL TRANSPARENCYAPP LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, data, or use
- Loss of goodwill or business opportunities
- Cost of substitute goods or services
- Personal injury or property damage
- Emotional distress
ARISING OUT OF OR RELATED TO:
- Your use of or inability to use the App
- Any conduct or content of any third party on the App
- Any content obtained from the App
- Unauthorized access, use, or alteration of your data
WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE GREATER OF:
- (a) The amount you paid us in the twelve (12) months preceding the claim, or
- (b) $100 USD
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
14. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless TransparencyApp LLC, its officers, directors, employees, agents, affiliates, and partners from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any rights of another person or entity
- Your User Content
- Your violation of any applicable laws or regulations
We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense of such claims.
15. TERMINATION
15.1 Termination by You
You may stop using the App and delete your account at any time through the App settings. Upon account deletion:
- Your User Content may be removed from the App
- Your access to Premium features will terminate
- Active subscriptions will remain active until the end of the current billing period
15.2 Termination by Us
We reserve the right to suspend or terminate your access to the App immediately, with or without notice, for any reason, including:
- Violation of these Terms
- Illegal or fraudulent activity
- Prolonged inactivity
- At our sole discretion
Upon termination:
- Your license to use the App terminates immediately
- We may delete your account and all associated data
- You remain liable for all amounts due under any active subscriptions
- Provisions that by their nature should survive termination shall survive (including indemnification, disclaimers, and limitations of liability)
16. DISPUTE RESOLUTION
16.1 Informal Resolution
Before filing any legal claim, you agree to first contact us at legal@transparencyapp.io to attempt informal resolution. We will attempt to resolve the dispute within 30 days.
16.2 Binding Arbitration
If informal resolution fails, you agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the App shall be settled by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.
The arbitration shall be conducted in Virginia, or at another mutually agreeable location. Each party shall bear its own costs and fees, unless the arbitrator awards costs and fees to the prevailing party.
YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
16.3 Exceptions to Arbitration
Either party may seek equitable relief in court for infringement or misappropriation of intellectual property rights.
17. CHANGES TO TERMS
We reserve the right to modify these Terms at any time. When we make material changes, we will:
- Update the "Last Updated" date at the top of these Terms
- Notify you via email (to the address associated with your account) or through the App
- For subscription-related changes, obtain your consent where required by law
Your continued use of the App after changes become effective constitutes your acceptance of the modified Terms.
If you do not agree to the modified Terms, you must stop using the App and may cancel your subscription.
18. APPLE-SPECIFIC TERMS
18.1 Acknowledgment
These Terms are between you and TransparencyApp LLC only, not with Apple Inc. ("Apple"). TransparencyApp LLC, not Apple, is solely responsible for the App and its content.
18.2 Scope of License
The license granted to you is limited to a non-transferable license to use the App on any Apple-branded device that you own or control and as permitted by the Apple App Store Terms of Service.
18.3 Maintenance and Support
TransparencyApp LLC is solely responsible for providing maintenance and support services for the App. Apple has no obligation to provide any maintenance or support services.
18.4 Warranty
TransparencyApp LLC is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. Apple has no warranty obligation with respect to the App.
18.5 Product Claims
TransparencyApp LLC, not Apple, is responsible for addressing any claims relating to the App or your use of it, including:
- Product liability claims
- Claims that the App fails to conform to legal or regulatory requirements
- Claims arising under consumer protection or similar legislation
18.6 Intellectual Property Infringement
In the event of any third-party claim that the App infringes that third party's intellectual property rights, TransparencyApp LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
18.7 Third-Party Beneficiary
Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
18.8 Legal Compliance
You represent and warrant that:
- You are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country
- You are not listed on any U.S. Government list of prohibited or restricted parties
19. GENERAL PROVISIONS
19.1 Entire Agreement
These Terms, together with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and TransparencyApp LLC regarding the App and supersede all prior agreements and understandings.
19.2 Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect.
19.3 No Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
19.4 Assignment
You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction.
19.5 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia and the United States, without regard to conflict of law principles.
19.6 Jurisdiction
You agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in Virginia for resolution of any disputes, except as provided in the Arbitration section above.
19.7 Export Control
You agree to comply with all applicable export and re-export control laws and regulations, including the Export Administration Regulations maintained by the U.S. Department of Commerce.
19.8 Government Users
If you are a U.S. Government user, the App is "commercial computer software" and "commercial computer software documentation" as those terms are used in 48 C.F.R. §12.212 or 48 C.F.R. §227.7202.
